Trademark Search is not a legal requirement before filing a Trademark, however, search indeed is a prudent act to do prior to filing a Trademark so that the applicant may become aware of already registered and applied trademarks which are similar to his. USPTO refuses the registration of a Trademark which is confusingly similar to an already registered Trademark. If the search results show some trademark pending or registered similar to the applicant’s mark it is not advisable to apply.
