Trademark is a protected sign which is used to distinguish the products or services of one business from another. Registration of a trademark gives the exclusive right to use a certain sign for specific goods and services or to grant someone else the right to use it by licensing or assignment. The trademark owner can prevent others from using an identical or similar sign for the same or similar goods and services.
In Switzerland the trademark is registered for a period of 10 years which is renewable for an indefinite period. and the state office charge one registration fee for three classes of goods and services.
Selecting the trademark class for the goods and service must be done very carefully. A trademark is always protected only for certain classes of goods and services. The applicant must indicate the goods and services for which he wishes to register and use his trademark. If the applicant fails to use his trademark for the products (or services) he claimed within five years of registration he can lose his trademark protection.
